1. About these terms

These Terms of Service govern your use of the Brainy application and the website at brainy.thematrixapp.com, provided by the Brainy team (“Brainy,” “we,” “us,” or “our”). By using our services, you agree to these terms. If you do not agree, do not use the services. Our Privacy Policy explains how information is handled.

You must have the legal capacity to accept these terms, or use Brainy with permission and supervision from a parent or legal guardian. The app’s availability and age rating are shown on its App Store listing. An age rating is not a statement that a child may independently agree to a contract or authorize a purchase.

Keep your device and Apple Account secure. You are responsible for purchases you authorize and for complying with the App Store terms applicable to your use. Do not share passwords or provide false information to obtain access.

2. Brainy Pro and in-app purchases

Brainy includes features that require a purchase. Pro provides access to the premium features described in the app at the time of purchase, including premium games, progress insights, complete assessment reports, and an ad-free experience. The available offers, exact price, currency, billing period, and any trial eligibility are displayed in the app and Apple’s purchase confirmation before you pay. Not every offer is available to every user or in every region.

• Weekly: an auto-renewable subscription with a one-week billing period.
• Yearly: an auto-renewable subscription with a one-year billing period.
• Lifetime: a non-consumable, one-time purchase of Pro access, when offered. It has no recurring charge. “Lifetime” refers to access for the supported lifetime of the Brainy service, not a promise that the service or every feature will remain available indefinitely. Statutory consumer rights remain unaffected.

Payment and renewal

Payment is charged to your Apple Account at confirmation of purchase. Auto-renewable subscriptions continue unless you cancel at least 24 hours before the current billing period ends. Your account is charged for renewal within 24 hours before the period ends at the applicable renewal price. Apple’s purchase flow and subscription settings show the current terms. Any price change is subject to Apple’s notice and consent processes and applicable law.

Trials and introductory offers

If a free trial or introductory offer is available, its duration and the price that applies afterward are shown before confirmation. A trial converts to the displayed paid subscription unless canceled at least 24 hours before it ends. Eligibility is determined through the App Store. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable. We do not guarantee a trial to every user.

Cancellation, restoration, and refunds

Manage or cancel subscriptions in your device’s Settings → your name → Subscriptions, or through Apple’s subscription management page. Cancellation generally stops the next renewal; access follows the period shown by Apple. Trial access may end when a trial is canceled. Deleting the app or requesting deletion of personal information does not cancel a subscription.

Use Restore Purchases in Brainy with the same Apple Account to restore eligible purchases. A lifetime purchase does not automatically cancel an existing weekly or yearly subscription; manage that subscription separately to prevent further renewals. For App Store refund requests, visit reportaproblem.apple.com. Apple handles purchase billing and refund eligibility under its policies and applicable law. Nothing here removes a refund or other remedy you are legally entitled to receive.

3. Games, progress, and self-reflection

Brainy offers games, daily workouts, progress tracking, quizzes, and self-reflection questionnaires. Scores and progress describe activity within Brainy. They are not standardized measurements of intelligence, clinical ability, or future performance. We do not guarantee that playing will improve memory, attention, intelligence, or other real-world abilities.

Questionnaires and results are intended for personal exploration and educational information. They are not medical advice, diagnoses, or treatment, and do not replace professional evaluation. Do not use Brainy to make medical, employment, educational admission, insurance, or other consequential decisions about someone. If you have concerns about your health or symptoms, consult a qualified professional. Brainy is not an emergency service.

Game progress and assessment records may be stored on your device. Deleting the app, resetting device data, or changing devices may affect those records. Purchase restoration restores eligible entitlements; it does not promise recovery or synchronization of local game or assessment data.

4. License, content, and acceptable use

The iOS application is licensed under Apple’s Licensed Application End User License Agreement (Standard EULA), except where a different applicable license is presented by the App Store. These service terms supplement that license. They do not remove rights granted by the applicable EULA or mandatory law. Apple is not responsible for providing Brainy’s customer support.

The app’s software, artwork, game content, brand, and other materials are protected by intellectual property rights. You may use Brainy for personal purposes within the license granted to you. You retain rights you have in information you choose to send us; we use support messages as described in the Privacy Policy.

You must not use the service unlawfully, attempt unauthorized access, interfere with security or operation, distribute malicious code, bypass payment or access controls, infringe another person’s rights, or copy or redistribute protected content without permission. Restrictions on reverse engineering apply only to the extent permitted by law.

5. Updates, availability, and ending use

We may update Brainy to maintain security, fix issues, or change features. We may also change or discontinue a feature or service. Where a change materially affects paid access, we will provide notice where reasonably practicable and honor applicable consumer rights and any required remedies. An outage or app update does not itself cancel an App Store subscription.

You may stop using Brainy at any time. Manage subscriptions separately as described above. We may restrict use that violates these terms, threatens security, or is unlawful, subject to applicable law. Contact us if you believe a restriction is an error.

We may revise these terms and update the date at the top. Material changes will be communicated through the app, website, or another appropriate channel. Where consent is legally required, we will request it.

6. Disclaimers and your legal rights

We aim to provide an enjoyable, reliable service, but do not promise uninterrupted availability or error-free content. To the extent permitted by applicable law, the service is provided “as is” and “as available.” We are not responsible for losses resulting from misuse of assessment results or use contrary to these terms, except where liability cannot lawfully be excluded.

Nothing in these terms excludes or limits mandatory warranties, statutory consumer rights, or liability that cannot legally be excluded or limited. These terms do not require you to waive a right to use a court or consumer protection process available under applicable law. If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted.
